Human rights lawyers sue Trump administration over the 'unconstitutional' ICC sanctions

Human rights lawyers launched a legal challenge on Thursday to U.S. President Donald Trump’s executive order imposing economic sanctions on employees of the world’s permanent war crimes tribunal, arguing it breaches the U.S. constitution.

A filing lodged at a district court in new york by the open society Justice Initiative, a public interest law centre that specialises in war crimes cases, names Trump, U.S. Secretary of State Mike Pompeo and 7 other members of his administration.

It argues that the executive order violates constitutional rights, including freedom of speech, and prevents the plaintiffs from carrying out work in support of international justice.


“By issuing this outrageous order, the Trump administration has betrayed Washington’s long-standing support for international justice, snubbed its allies, and violated the U.S. constitution,” open society Justice Initiative executive James Goldston said during a statement.


“We are going to court to end this reckless assault on a judicial institution and the victims it serves.”

Trump authorised U.S. economic and travel sanctions against employees of the Hague-based International criminal court and anyone supporting its work on June 12, citing their involvement in an investigation into whether American forces committed war crimes in Afghanistan.


On Sept. 2, Pompeo said ICC prosecutor Fatou Bensouda had been blacklisted.


The ICC has said the measures are an attack on the court, the system of international criminal justice and therefore the rule of law more generally.

European Union countries and rights groups have rejected the U.S. sanctions as detrimental to efforts to secure international justice for war crimes.

Measures include freezing the U.S. assets of those who help the ICC investigate or prosecute americans without U.S. consent, and barring them and their families from the u. s..


The main target of the move is Bensouda, who was granted approval in March to investigate possible crimes committed in Afghanistan between 2003 and 2014.


These include alleged mass killings of civilians by the Taliban also because the alleged torture of prisoners by Afghan authorities and, to a lesser extent, by U.S. forces and also the CIA.


Announcing the executive order in June, U.S. Secretary of State Mike Pompeo described the ICC, established in 2002 by the international community to prosecute war crimes, genocide and crimes against humanity, as a “kangaroo court”.


Trump administration officials also said it threatened to infringe on U.S. national sovereignty and accused Russia of manipulating it to serve Moscow’s ends.

IPL 2020: Mumbai Indians (MI) defeated Kings XI Punjab (KXIP) comprehensively by 48 runs to register their second win of the ongoing Indian Premier League (IPL) 2020 season at the Dubai International Stadium in Dubai on Thursday. After suffering a super Over defeat against Royal Challengers Bangalore in their last game, Mumbai Indians bounced back to winnings ways with a clinical display from both the batsmen and also the bowlers against the KL Rahul-led side.

While captain Rohit Sharma led from the front with the bat, Jasprit Bumrah once more proved why he's one among the best fast bowlers in the world at the moment. While Rohit played a captain's knock, Kieron Pollard and Hardik Pandya hammered two sensational cameos towards the end to power Mumbai Indians to a powerful total of 191 runs on the board. While Pollard hammered 47 off 20 balls with the help of 4 sixes, Pandya slammed 3 boundaries and a couple of sixes in his quickfire 11-ball 30. The duo took the KXIP bowlers apart as they made a mockery of the opposition bowling attack.


In reply, Kings XI Punjab never looked settled in the run chase as they succumbed to another defeat. KXIP have now lost back-to-back games and have managed just one win in their first four games of the season. While Rahul struggled to get going in his 19-ball 17, his opening partner Mayank Agarwal scored 25 off 18 balls. The duo added 38 runs for the first wicket before the middle-order crumbled under pressure.

The likes of Karun Nair (0), Glenn Maxwell (11), James Neesham (7) and Sarfaraz Khan (7) all disappointed with the bat as KXIP were restricted on 143/7 despite playing 8 batsmen within the XI. Nicholas Pooran top-scored with a 27-ball 44 while Krishnappa Gowtham showed some fight towards the end with a 13-ball 22 but their efforts weren't enough to get KXIp over the line in a very pressure chase.


Jasprit Bumrah was yet again exceptional for Mumbai Indians as he returned with figures of 2/18 in his 4 overs, bowling at an impressive economy of 4.50. Rahul Chahar also impressed with 2 for 26 off his 4 overs. it had been a complete bowling effort from Mumbai Indians with all five bowlers on the mark and getting a wicket each for their efforts.

Unlock 5.0 : Re-opening guidelines of India out,cinemas to reopen on October 15

October are going to be crucial due to Durga Puja and therefore the first phase of Bihar Assembly Election 2020. The Centre’s focus would be more on reopening adhering to social-distancing norms

India News: The ministry of home affairs has announced a detailed guideline for Unlock 5.0, or for reopening to be effective from October 1, shortly. Despite a steep rise in the number of Covid-19 cases in the country, the home ministry has made it clear that there would be more relaxations and fewer restrictions, though local administrations in some states are heavily counting on voluntary curfew, local lockdowns etc.


Here are the guidelines:


* Cinemas/ theatres/ multiplexes are going to be permitted to open with upto 50% of their seating capacity, for which, SOP are going to be issued by Ministry of information & Broadcasting.


* Business to Business (B2B) Exhibitions are going to be permitted to open, for which, SOP are going to be issued by the Department of Commerce.


* Swimming pools being used for training of sportspersons are going to be permitted to open, for which the standard operating procedure (SOP) are going to be issued by Ministry of Youth Affairs & Sports (MoYA&S).


* Entertainment parks and similar places are going to be permitted to open, for which the SOP are going to be issued by Ministry of Health & Family Welfare (MoHFW).

Opening of schools, colleges, education institutions and coaching institutions


* For re-opening of schools and coaching institutions, State/ UT Governments have been given the flexibility to take a decision after October 15, 2020, in a graded manner. the decision shall be taken in consultation with the respective school/ institution management, based on their assessment of the situation, and subject to the subsequent conditions:


* Online/ distance learning shall still be the preferred mode of teaching and shall be encouraged.

* Where schools are conducting online classes, and some students prefer to attend online classes instead of physically attend school, they'll be permitted to do so.


* Students may attend schools/ institutions only with the written consent of parents.


* Attendance must not be enforced, and must depend entirely on parental consent.

* States /UTs will prepare their own SOP regarding health and safety precautions for reopening of schools/ institutions based on the SOP to be issued by Department of school Education and Literacy (DoSEL), Ministry of Education, Government of India, keeping local requirements in view.


* Schools, which are allowed to open, will need to mandatorily follow the SOP to be issued by Education Departments of States/ UTs.


* Department of higher Education (DHE), Ministry of Education may take a decision on the timing of the opening of Colleges/ higher education Institutions, in consultation with Ministry of Home Affairs (MHA), based on the assessment of the situation. Online/ distance learning shall still be the preferred mode of teaching and shall be encouraged.

Unlock 5.0 is probably going to become the most crucial as a number of religious festivals are scheduled in October, including Durga Puja. the first phase of Bihar Assembly Election 2020 is scheduled on October 28. The Centre is probably going to revise its order concerning the maximum number of individuals who can gather at an area .


The phase-wise unlocking began in June with only some essential activities beginning outside the containment zones. Over the last four months, offices, public transport including metro, domestic flights, religious places, restaurants, hotels, gyms, schools and colleges are allowed to resume activities, though the state governments concerned are the ultimate authorities.


Tamil Nadu and Maharashtra have extended lockdown till October 31.

IPL 2020: Kolkata Knight Riders defeated Rajasthan Royals by 37 runs in the 12th match of IPL 2020. Kolkata, batting first after losing the toss, scored 174 runs in 20 overs for the loss of six wickets. In response, Rajasthan's team could only manage 137 runs at the loss of 9 wickets in the scheduled overs.


Earlier, after losing the toss and coming to bat first, Kolkata got the first blow as Sunil Narine on the score of 36 runs. Narine was bowled out by Jaydev Unadkat for 15 runs.
